FAMILY LAW OVERVIEW
Family Law has gone through a dramatic overhaul in the past couple of years. The divorce rate is at
60%, more individuals are representing themselves in the court room and discrimination against
traditional family roles are dramatically changing in not only the family structure, but in the
courtroom as well. Divorce Law has changed dramatically in the past couple of years, brought on by
society itself. It has created an America that is uneasy about the institution of marriage and
children. Where are the couples that have achieved marriage for twenty years, thirty years, and
fifty years? These couples don’t exist anymore. It’s too easy to get a divorce these days and more
and more people are just giving up, saying “it didn’t work, I’m getting a divorce.” It has become a
society that is so accustomed to having their way and getting immediate gratification for all
situations that no one looks at the effects that these events have on society.
No longer does the traditional family home consist of a parent who stays home and tends to the
children, a “homemaker”. This concept has evaporated. No family can afford to not have both parents
working, especially with the high cost of day care, extra circular activities, etc. So who looses out in
these situations? The children do! Combine that with two people who aren’t suited for each other,
or who constantly disagree, fight and/or alienate their children, and you are left with what society
has called “marriage” in the twenty-first century. It’s a sad commentary that something so long in
tradition, has seen so many changes.
No one person is to blame. It’s the laws that allow for divorce to be so easy to obtain, its society
who suggests what a happy marriage is and it’s the role models that children have, that don’t impose
what values and beliefs are. The message we are sending to the children of America is that you can
“try” marriage and if it doesn’t work out, do what 60% of the American public is doing, get a
divorce. The laws need to be changed, the roles that parents take on need to be changed and
someone needs to think about what effect all of these issues are having on children being raised in
one or two family homes. It’s all of these reasons why Family Law has become drastically different
in the twenty-first century, why the nature and scope of Family Law litigation has become so
cumbersome and why you need to have an Advocate help you to understand all the nuances that
pertain to domestic disputes. It’s an ever changing and challenging area of the law. Our advise is to
