1. What is Family Law?
Family law consists of laws that define relationships, rights and duties within the family unit, most
usually found in such relationships formed by marriage. As times have changed and the institution
of marriage has changed, so too have the ways that people deal with marriage, their rights, duties
and the family unit. The two parents household, the stay at home parent and the opportunities for
child care/extended care have expanded. The way that our grandparents raised their children is
vastly different from the way that parents in the twenty-first century are raising theirs. Both
parents now work, children stay at after school programs, dinner is usually a fly-by-night event, it’s
no longer a planned activity. Many children are required to do their homework without parental
supervision, as their parents work all day and when they get home; it’s time to work on the family
chores.
2. What governs Family Law?
Family Law is created and enforced by the States. There are many similarities and guidelines that
each state must use (in the case of child support), however, each state determines what laws will
apply to their constituents. Family Law is becoming increasingly more complex. With same sex
marriages occurring, with both parents working, and with different issues affecting children, the
laws need to change with the times.
3. What’s included in Family Law?
Family Law is comprised on divorce/separation/annulment law, laws of custody, support laws,
criminal law, juvenile law and civil procedure, to name a few. It usually consists of items that are
related to the family. Whether it’s children’s issues, support issues, educational issues, or
violence/abuse issues, each has a place within the scope of Family Law. That’s what makes it such a
broad category, with so many facets involved.
4. Do I need an Attorney that specializes in Family Law?
Each attorney has their own strengths and weaknesses and depending on that nature of your case,
you may choose to select an attorney who specializes in this area. I would recommend that you

dispute, decide who the best choice would be. Once you have clearly identified the nature of your
case, what you want and what you are willing to do to achieve that goal, you will be able to determine
